
AINA CAR RENTAL, SL, hereinafter also referred to as “Aina Car” or the “LESSOR”, STATES:
The vehicles subject to rental are owned by the holder of the registration permit that must accompany it, to whom AINA CAR RENTAL, SL has leased the vehicle or is the owner.
The LESSOR is expressly authorized by the Owner to rent their vehicles to third parties, as well as to claim any incidents, damages, and losses caused to the vehicle.
The GENERAL TERMS and CONDITIONS OF RENTAL shall apply to the person signing the Rental Contract, hereinafter defined as “You” or the “LESSEE”, and who provides a credit card as a guarantee for the Vehicle. The person signing the Rental Contract (regardless of whether they are listed as the driver of the Rented Vehicle) as well as any (other) driver expressly indicated in the Rental Contract, and therefore authorized to drive the Vehicle, will assume all costs associated with the Rental Contract.
All persons identified in the rental contract will be jointly and severally liable for the payment of any amount owed under the contract.
In the event that the reservation was made and prepaid by a third party, different from the lessee (understood as the person who signs the Rental Contract and is the holder of the credit card provided as a guarantee), and such third party subsequently rejects the charge made by Aina Car as a prepayment for the rental, Aina Car may directly require the LESSEE (and jointly and severally the authorized drivers listed in the Rental Contract) to pay that amount.
To be able to rent a vehicle with Aina Car, the LESSEE must be a natural person who is legally capable of entering into a contract with Aina Car and who is prepared to accept responsibility for the Vehicle during the Rental Period. At the same time, they must possess the accepted means of payment to pay for the Vehicle rental and associated costs as well as valid and current identification documents accepted by Aina Car (see the General Information About the Rental section).
An authorized driver will be any natural person expressly mentioned and fully identified in the Rental Contract (this may also be the Lessee), who has a valid identification document (Identity Card or Passport) and a valid driving license with a minimum age of 2 years and is over 21 or 25 years old depending on the category of the Vehicle.
An unauthorized driver to drive the Vehicle includes those not expressly mentioned/identified in the Rental Contract as well as those who do not provide valid and accepted identification documents by Aina Car.
If You allow an unauthorized person to drive the Vehicle, this will be considered a breach of the GENERAL TERMS and CONDITIONS OF RENTAL and You will be responsible for the consequences that may arise from this act, including the possibility of being held liable to Aina Car for damages caused by You and/or such unauthorized person. In such circumstances, it is possible that neither You nor the unauthorized driver will be covered by protection products or insurance offered through Aina Car.
In this case, the unauthorized driver will not be covered by any insurance or protection products offered by Aina Car except for the Mandatory Civil Liability Insurance of the Automobile, which will apply in all cases.
Those leasing companies that do not communicate the name of the vehicle's driver expressly accept responsibility for any incidents, damages, and losses caused to the vehicle during the validity of this Rental Contract.
The LESSEE and/or DRIVER, whose personal circumstances are listed in the Rental Contract, accepts and receives the vehicle and accessories specified therein.
The rental period is the one agreed upon in the specific conditions of the rental contract. The departure and expected return dates are binding for both parties. If the lessee, by their own decision, starts late or ends the rental early, they will not be entitled to any refund.
When picking up the Vehicle from Aina Car, you will be asked to sign, among other things, a section of the Rental Contract (Vehicle Inspection Form) that will describe the condition of the Vehicle at that specific time. You acknowledge that you receive the VEHICLE in perfect working order. All five tires are in good condition and it has all standard and mandatory accessories for its circulation, complying with the Traffic Code.
In case of deterioration due to loss, theft, or misuse of accessories, tools, spare tires, batteries,... and especially tires, You agree to replace it immediately at your own expense with a tire of identical characteristics and usage condition. Damage to wheels, hubcaps, and interior of the vehicle will be borne by the lessee. The odometer cannot be tampered with. If it does not function correctly due to a fault or tampering, it must be reported immediately for repair. Otherwise, the LESSOR is authorized to bill You at a rate of 1,000 kilometers per day of rental according to the price reflected in the tariff guide and additional charges.
If you notice any visible damage or defect in the vehicle that is not described in the Rental Contract and/or the inspection form when picking up the vehicle, you must ensure that these damages or defects are added and that You and the agent designated by Aina Car sign this modification of the vehicle inspection form before removing the vehicle from the Aina Car office or the designated pickup/drop-off point. If you do not request this modification under the indicated terms, Aina Car will be entitled to assume that you have accepted the Vehicle in the condition described in the rental contract and its inspection form, and therefore, to invoice and charge for all those damages detected in the Vehicle, by you and by the agent designated by Aina Car, at the time of its return.
If the LESSEE and/or DRIVER decides to extend the Rental Contract, they must follow the following steps: · Call the rental office phone number that you will find printed on your rental contract. · Go to an Aina car office. · Carry out a vehicle inspection together with an agent designated by Aina car. · Pay the rental and additional charges. · Sign a new Rental Contract or an addendum to the initial contract. If you do not proceed under the indicated terms and do not return the vehicle on the agreed date and time, the provisions set out in the “Vehicle Return” section will apply. Once the scheduled return date has arrived, the contract is considered expired, with the inherent responsibilities. Under no circumstances may the deposit be used to extend the Rental.
a) Return of the Vehicle during Aina Car office opening hours The lessee must return the Vehicle to the Ainacar office or return point indicated in the Rental Contract, on the date and time specified in the mentioned Contract. If desired, you may return the Vehicle to another Aina Car office different from the pickup location, if you subscribe to the service that enables this ONE WAY option, and pay the corresponding amount according to the services/extras fees available at Aina Car offices and/or on the Aina Car website. Any modification of the initial contract requires the express authorization of Aina Car through a document signed by Aina Car and the lessee. The Rental Period will end when you return the Vehicle to the Aina Car office and hand over the keys and Vehicle documentation to an Aina Car agent or representative. No refund will be made if you return the Vehicle before the agreed date and time in the Rental Contract. When returning the Vehicle to Aina Car, you must inspect it together with the agent designated by Aina Car and sign a report on the condition of the Vehicle at the time of return. Aina Car will provide you with a signed document confirming the return of the Vehicle. Aina Car is not responsible for any property and/or items you may have forgotten inside the Vehicle.
b) “After-Hours Return” Service Aina Car recommends returning the Vehicle during the office opening hours. However, to meet the specific needs of some of our customers, Aina Car offers an additional “After-Hours Return” service at certain locations. If you choose to use this “After-Hours Return” service, you agree that the Vehicle condition report may be prepared by an agent designated by Aina Car without your presence and after returning the keys. In particular, you must report any incident and/or Damage affecting the Vehicle's condition in the document provided for this purpose when you collected the Vehicle. You must return this document along with the corresponding accident report, if applicable, duly completed, and the keys in the “key drop box” provided for this purpose. Please note that the Rental Contract does not automatically terminate when you return the keys: the Vehicle will remain in the parking spot where you have parked it until the Aina Car station opens, which will then inspect the Vehicle and close your Rental Contract. Therefore, Aina Car reminds you that you must park the Vehicle in the designated area, if applicable, and always comply with applicable regulations, so that the Vehicle does not pose a danger to others or obstruct traffic. You must also leave the vehicle documentation in the glove compartment. Since the Vehicle will be inspected later - during the station's opening hours, Aina Car recommends that you take photographs/videos of the Vehicle to have evidence of the vehicle's condition upon return and before returning the keys. Once the inspection has been carried out and in the absence of damage, Aina Car will send you a signed document declaring that the vehicle has been returned without damage. Aina Car is not responsible for any property and/or items that may have been forgotten in the Vehicle.
c) Return of the Vehicle without your presence and during Aina Car office opening hours In case you could not and/or declined to inspect the Vehicle together with the Aina Car agent or its representative, Aina Car is authorized to inspect the Vehicle on its own, without your presence, and to record your refusal to review the vehicle. The previously described Procedure will apply (see section b)).
d) Late Vehicle Return Unauthorized delays in return or not due to justified force majeure will result in the rent eventually generated. A rental day is understood as the time between 8:00 a.m. and 7:00 p.m. of the same day. If the Vehicle is not returned on the date indicated in the Rental Contract and after a period of 24 hours without hearing from you, Aina Car may consider that the Vehicle has been misappropriated, reporting this to the local authorities. In such a case, Aina Car will be entitled to claim all damages caused to Aina Car, including, if applicable, the value of the Vehicle, as well as all fines, tolls, penalties, or sanctions imposed on the rented Vehicle as a result of requests made by public administrations to identify the offender or to clarify other circumstances related to possible violations or crimes. Aina Car will also be entitled to initiate legal proceedings to claim the immediate return of the Vehicle. In such a case, protections and other additional contractual services will have no effect.
Any additional charges will be billed to you upon return of the Vehicle (as long as they can be calculated at that time). Ainacar may also charge for various services that must be provided directly or through third parties in relation to incidents that may have occurred during the Rental Period and/or in relation to the use of the vehicle. The prices (including VAT) of these charges and costs are specified in the Tariff and Additional Charges Guide, which you can consult on our website (if the reservation was made online) and will be available at any Aina Car office and in any case on the conditions section of our website www.ainacar.cat; www.ainacar.com; www.ainacar.es. These charges or costs include, but are not limited to: · Administrative charges for the processing of fines or tolls as well as the amount claimed by the issuing entity. Please note that these administrative costs are paid in addition to the fine or fee they are associated with, and You are fully responsible for paying such fines or tolls. · Cleaning charge for a Vehicle returned in an unacceptable state of cleanliness (beyond what is expected from ordinary use). · Charges for loss or theft of keys. · “Damage” or losses caused to the vehicle during the rental not covered by the protections you may have contracted. · Administrative charge for the management of such Damages. · Fuel used during the Rental Period. · Kilometers exceeding the mileage included in the rental rate. · Charges associated with rentals made at offices located in airports, authorized pickup/drop-off points, or home delivery services. · Additional charges and costs resulting from other events that may occur during your rental. In these cases, Aina Car will make the corresponding charge for additional charges at a later date, when Aina Car becomes aware of them and once the Rental Period has ended. In this case, You will have a period of fourteen (14) days from the date of sending (by email or regular mail) the billing notification to respond and justify that You are not responsible for these amounts. If you do not communicate any objection or justification within the indicated period, the mentioned amounts will be charged. The liability/deposit set in the Rental Contract will be returned to the LESSEE and/or DRIVER at the end of the Contract, after the vehicle inspection. In case the vehicle suffers any damage not covered by insurance, the amount will be deducted from the liability/deposit and any remaining amounts once it is exhausted, the LESSEE and/or DRIVER is obligated and agrees to reimburse the LESSOR within a maximum period of 10 calendar days.
When renting a Vehicle from Aina Car, You and/or any Authorized Driver must comply with the following obligations: You must return the Vehicle, keys, accessories, and documentation to the Aina Car station mentioned in the Rental Contract, on the due date and time specified in said Contract (a grace period of 59 minutes is allowed). If you do not return the Vehicle under the indicated terms, Aina Car may take all necessary measures described in these clauses and in particular in the Vehicle Return section. Neither You nor any Authorized Driver may drive the Vehicle outside the National Territory. If You and/or the Driver drive the Vehicle outside the National Territory, You and/or the Driver must obtain prior written consent from Aina Car. Additionally, upon collecting the Vehicle, you must ensure that it has the correct equipment to comply with the local traffic regulations of the country in which You and/or the Driver will be driving. If the vehicle is used to transport persons of a height equal to or less than 135 centimeters, You must inform Aina Car so that it can provide you, if available and without being installed in the vehicle, the corresponding mandatory restraint device approved according to the weight and height of the child or person who should use it, along with detailed instructions from the manufacturer for the correct installation of the seat and the child or person using it. Aina Car is under no obligation to install and/or place such a mandatory restraint device in the vehicle, limiting itself to fulfilling this obligation by delivering it upon your request. Check the price of this accessory in the tariff guide, accessories, and additional charges section. In any case, Aina Car will be free from any possible liability for personal or material damages caused as a result of Your failure to comply with the aforementioned communication obligation, as well as for the non-use of the mandatory restraint device or its incorrect installation or use, and for any possible manufacturing defect of the mentioned mandatory restraint device. You must ensure that all luggage or goods transported in the Vehicle are secure so that they cannot cause damage to the Vehicle or pose risks to passengers. You and/or the driver undertake to safeguard the Vehicle with the utmost care, with the diligence of a good family man, and in any case, to ensure that it is locked and protected by anti-theft devices and not parked in unauthorized spaces or left unattended. Both You and any Authorized Driver agree never to drive the Vehicle or allow it to be used under the influence of alcohol, hallucinogenic drugs, narcotics, barbiturates, other illegal substances, or any other substance (whether legal or illegal) that may interfere with your driving ability or that of the Driver. You and/or the Driver must refuel the vehicle with the appropriate type of fuel. If incorrect fuel is used and unless you can prove that the error is attributable to a third party, You will be responsible for the costs incurred in towing the Vehicle and/or repairing the Damage caused to it, calculated according to the rules described in the subsequent section entitled Vehicle Damage. Neither You nor the Driver may use the vehicle or allow the vehicle to be used for: Subleasing, mortgaging, pawning, selling, or otherwise offering as collateral either the Vehicle or any part thereof, as well as the Rental Contract, the keys, documentation, equipment, tools, and/or any of its accessories. Carrying passengers for profit unless expressly authorized by Aina Car and the LESSEE has the pertinent authorization. Carrying a number of persons exceeding that established in the Vehicle Registration Permit and/or the Vehicle Technical Inspection Certificate. Carrying flammable and/or dangerous, toxic, harmful, and/or radioactive products, or products that violate current legal provisions (provided that such exclusion does not prevent you from meeting daily needs that do not violate applicable regulations and whose transportation corresponds to a normal and ordinary use of the Vehicle). Transporting goods with a weight, quantity, and/or volume exceeding that authorized in the Vehicle Registration Permit and/or the Vehicle Technical Inspection Certificate. Participating in races, off-road driving, reliability or endurance tests, speed tests, or participating in Rallies, competitions, or tests, regardless of the location, whether official or not. Transporting live animals, except for pets and/or domestic animals, subject to the express authorization of Aina Car. These must always travel in a transportation system approved for animal transport and anchored in the trunk area of the vehicle, provided the vehicle allows it. Under no circumstances may they travel in seats intended for people. Providing driving lessons. Pushing or towing another vehicle or trailer, except when expressly authorized by Aina Car, and when the rented Vehicle is already equipped with a towing hook, with the maximum load specified in each contract and the lessee possesses the necessary driving licenses. Driving on gravel tracks or roads not suitable for motor vehicles or whose surface or condition poses risks to the tires, the underside of the Vehicle, or the Vehicle itself, such as beaches, unsuitable roads, forest tracks, mountains, etc., that are not authorized, and unpaved roads, except with the express and written authorization of Aina Car. Committing intentional crimes. Transporting it on board any type of boat, train, truck, or plane unless Aina Car has given express authorization for it. Within ports, airports, and/or aerodromes and/or similar facilities of a non-public traffic nature, or in a refinery and facilities or premises of an oil company, without the express written authorization of Aina Car. If Aina Car gives its consent as mentioned above, Aina Car will inform you of the applicable third-party liability insurance coverage, which may vary depending on the circumstances. You may be held liable to Aina Car for any detrimental consequences resulting from non-compliance with the above obligations. Please note that non-compliance with these obligations may limit your right to claim damages that you may seek. In this case, Aina Car reserves the right to demand the immediate return of the Vehicle.
In the event of a mechanical breakdown or accident that prevents you from continuing your journey and/or forces you to stop the Vehicle to prevent a breakdown, you have access to a roadside assistance service, included in the price of your rental. If you wish to use this service, you must call the phone number indicated in the vehicle documentation. In case of an accident, you must inform us within a period of 24/48 hours from the moment the collision or traffic accident occurred and, in any case, before the end of your rental period. You must also provide us with a fully completed accident report and any other documents that may be useful to supplement your statement. If the LESSEE does not notify the LESSOR of any accident or breakdown that the rented vehicle may have suffered, they will be solely responsible for any damages and losses incurred. In case of contract termination due to LESSEE's non-compliance, accident, or breakdown, the LESSEE expressly authorizes the LESSOR to remove the vehicle from wherever it is located, with the LESSEE bearing the costs incurred. It is the LESSOR's obligation to notify the LESSEE of the day and time the vehicle has entered the base and, if applicable, to indicate the workshop where it is located, so that the LESSEE can carry out the appropriate checks. In the event of partial or total theft of the vehicle, appropriate measures will be taken to protect and safeguard it. The nearest rental office will be informed of the reported events, submitting the original of the report within 24 hours from its filing, except for situations of force majeure, and in any case, before the end of the agreed rental period, along with the original keys of the Rental Vehicle. The Lessee will authorize Aina Car to terminate the contract outright and demand the immediate return of the Vehicle. In this case, Aina Car may consider the obligation as overdue and require immediate payment of the entire outstanding debt, regardless of previously agreed payment terms. The replacement vehicle service, when included in the Rental Contract, only covers cases of warranty repairs or periodic maintenance service. THE LESSEE and THE DRIVER commit to: a) Inform the LESSOR within a maximum period of 24 hours of any accident, breakdown, theft, or fire, as well as the Police authorities of any bodily harm, theft. You will find the contact details and channels in the rental contract and on our website. b) Include in your statement the circumstances of the place, date, and time of the accident, name, phone number, and address of witnesses, name, phone number, and address of the owner of the other vehicle, its license plate, and Insurance Company, as well as the policy number. c) Attach to this statement any report from the Police, Civil Guard, or Court if applicable. d) Not to discuss responsibility or settle with third parties regarding the accident under any circumstances.
The insurance / PROTECTION for the rented vehicle includes Mandatory Civil Liability Insurance according to current legal provisions and a Complementary Civil Liability Insurance with a maximum insured amount up to EUR 50 million in excess of the mandatory liability insurance limits and is limited to Europe. The Insurance extends only to the intended duration specified in this rental contract. After this period, the lessor declines any liability for accidents and damages that the LESSEE and THE DRIVER may cause, of which they will be jointly responsible. The importance of this section is linked to clause No. 3 of the clauses. The insurance only covers authorized drivers aged at least 21 and holding a valid and current driving license, with a minimum validity of 2 years. For those under 26 years old, the deductible amount can be up to three times the normal value applied and entails additional charges. When the driver acts in bad faith or is not in normal conditions due to alcohol or drug intake or any other reason, the LESSEE and THE DRIVER will be jointly responsible for any damage or injury they may cause to third parties, to the vehicle, and to the LESSOR. For more information about Insurance and Coverage, consult the General Information on Rental section. The INSURANCE does not cover damage caused to the vehicle by violations of the Traffic Code and Municipal Ordinances. The LESSEE will pay the fines that may be imposed by the competent Authorities for the aforementioned violations. A charge of €30 + VAT will be made for the Management of each fine/sanction attributable to the lessee.
CDW (Basic Vehicle Damage Protection): CDW is an optional service provided directly by Aina Car that exempts the lessee (except for the deductible amount) from financial liability for damage caused to the Vehicle while it is being driven due to a collision with other vehicles or fixed or moving objects, excluding damage caused by acts of vandalism unless these occur during the use of the Vehicle. Damage to the underside and/or roof of the vehicle, glass, rims, and/or tires is excluded. SCDW (Super Vehicle Damage Protection): Reduces the lessee's deductible amount not covered by CDW for vehicle damage. SCDW is an optional service provided directly by Aina Car and is offered specifically to certain customer groups and/or vehicles. By opting for SCDW, the lessee is partially exempted from the minimum amount payable (deductible) not covered by CDW. The deductible amount is set in the General Rate, or the contracted rate and its specific conditions, and may appear in the Rental Contract regardless of whether SCDW has been contracted. The CDW and SCDW coverages are only applicable if you duly complete the accident form, which must clearly include the details of the vehicles and drivers involved in the accident and the conditions and circumstances in which it occurred. TP (Basic Theft Protection): Exemption (except for the deductible amount) from liability in case of total or partial theft of the vehicle, and damage caused to it by acts of vandalism while parked when it is not being used by you. TP is an optional service provided directly by Aina Car that exempts the lessee (except for the corresponding deductible amount) from financial liability only for total or partial theft of the Vehicle and damage caused to it for these reasons and/or by acts of vandalism while parked when it is not being used by you. In no case will TP cover the total or partial theft and damage caused to glass, windows, mirrors, rims, and tires of the rented vehicle when they occur in circumstances other than those described above. TP coverage is only applicable if you return the original set of keys for the rented vehicle, which was provided to you at the time of contract formalization, without any tampering, as well as the original report of the incident filed with the relevant authorities. WWI (Windshield, Glass, and Tire Protection): WWI is an optional service provided directly by Aina Car and is offered specifically for certain customer groups and/or vehicles. By opting for this service, the following protections are offered: Exemption from payment for damages and/or losses caused solely and exclusively to the windshield, windows, and mirrors of the rented vehicle as a result of damage caused by impacts from stones and/or other objects. Exemption from payment for damages and/or losses caused to the rims and tires of the rented vehicle, including the spare tire, when they have been caused as a result of punctures or impacts against curbs during parking maneuvers. If WWI is contracted as an individual product or as part of a Protection combination package, no deductible will apply to the damages caused to the mentioned elements and circumstances, provided that the above conditions are met. If WWI is contracted and the conditions and circumstances described above are not met, the damages described in this section will be subject to the partial deductible amount established in the General Rate or the contracted rate. In any case, the amount of this deductible may appear in the rental contract regardless of the mode (individual product or part of a Protection combination package) under which the WWI has been contracted. PAI (Personal Accident Protection): PAI offers personal protection in the event of an accident, guaranteeing both the driver and the Vehicle Passengers, through its contracting, compensation in case of death and/or permanent disability, and limited reimbursement of medical expenses incurred in the event of a collision or traffic accident during the use of the rented vehicle. GIT (Goods Protection for Cargo Vans): GIT offers protection exclusively applicable to rentals of Industrial Vehicles and Cargo Vans, guaranteeing, through its contracting, limited compensation for damages or losses suffered by the goods transported by You in the Vehicle as a result of a collision, traffic accident, or theft. The coverage provided by PAI, GIT, and the Mandatory Civil Liability Insurance for damages caused to third parties is guaranteed by the insurer with whom the Lessor or the owner of the Vehicle has the applicable insurance policy, subject to the general and specific terms of the insurer's policy (a copy of which can be consulted at all Aina Car offices) and the Law.
Normal mechanical wear and maintenance are the responsibility of the LESSOR. During the rental, and according to the mileage covered, the LESSEE and the DRIVER will be responsible for ordinary maintenance resulting from the normal use of the Vehicle, and therefore must carry out regular checks of the water and oil levels and tire pressure. You must take all necessary protective measures to keep the Vehicle in good working condition. You must also remain alert to the signals from the warning lights and/or sounds of the vehicle's instrument panel and take all necessary protective measures for the Vehicle's engine and the Vehicle as a whole. Unless prior, express, and written authorization is given by Aina Car, any modification or mechanical intervention on the Vehicle, its keys, equipment, tools, and accessories is prohibited. In case of non-compliance, you must bear the costs, duly justified, of restoring the Vehicle to its condition at the time of pickup and pay an indemnity for the immobilization of the Vehicle, which will be calculated according to the criteria established in the mentioned list of average repair and replacement costs. The LESSEE and the DRIVER will be liable to Aina Car for any detrimental consequences resulting from non-compliance with the maintenance obligations mentioned above. If the vehicle becomes immobilized for any reason, the LESSEE and/or DRIVER cannot claim damages for the delay in vehicle delivery, rental cancellation, or immobilization due to repairs carried out during the rental period. The LESSOR is not obliged to replace the affected vehicle and will not be responsible in case of bodily injury or material damage caused by construction defects or previous repairs. Improper mechanical use of the vehicle, once proven by a competent expert, will entitle the LESSOR to initiate legal and extrajudicial proceedings to claim damages caused to the VEHICLE or third parties, directly against You.
Fuel is the responsibility of the LESSEE. As a general rule, vehicles are delivered with a full tank. In exceptional cases, such as a lack of fuel at the pickup office, the fuel level may be lower than full. In any case, when returning the vehicle, it must be returned with the fuel tank at the same level as when it was collected. The LESSOR will not reimburse unused fuel. If the vehicle is not returned with a full fuel tank, the cost of the missing fuel will be charged, plus a refueling service fee established in the Guide to Rates and available at Aina Car offices and in any case on the Aina Car website.
In the event of a dispute between You and Aina Car regarding your rental, the applicable law will be the law of Spain.

All notifications related to the Rental Contract will be sent to the addresses indicated in it. Any notification made to these addresses will have full contractual effect unless a new address has been previously notified in writing to the other party.
All matters arising between the LESSEE and/or driver and Aina Car as a result of this Contract, the parties, waiving their own forum/jurisdiction, submit to the Jurisdiction of the Courts and Tribunals of Sabadell.
The binding documents between the LESSEE and/or driver and Aina Car are, in order of priority, the following: · The Rental Contract and its conditions, · The General Conditions contained in the Information on Insurance, Coverages, and Exclusions, · The Guide to Rates and Additional Charges, · The confirmation email you will receive upon reserving the Vehicle, · These TERMS and GENERAL CONDITIONS OF RENTAL, which will apply to the aforementioned documents.
By signing the rental contract, the LESSEE is informed in writing of the existence of and accepts the TERMS and GENERAL CONDITIONS OF RENTAL available on our website www.ainacar.cat. The LESSEE also acknowledges and declares that they have read and fully understood the aforementioned clauses and, finding them acceptable, ACCEPTS them.
Basic protection for the rented vehicle includes Third-Party Liability Insurance, extended coverage for vehicle damage with a deductible, and roadside assistance. Basic Protection The BASIC coverage protection package is already included in your rental, along with roadside assistance from kilometer 0. It reduces the liability of the LESSEE and DRIVER in case of vehicle damage caused by a collision, acts of vandalism, or in the event of theft or attempted theft of the vehicle. In these cases, the LESSEE and DRIVER will be responsible up to a maximum variable amount (deductible) depending on the selected vehicle. Complete Protection The Complete Protection coverage, in addition to offering all the benefits of basic coverage, includes a reduction of the deductible amount (up to an 80% reduction), a personal accident insurance that provides coverage in case of injury or death of the driver and/or passengers during the rental due to a collision or traffic accident (civil liability insurance with a maximum insured amount of up to €15,000 for personal injuries and damages). Additionally, this package includes extra protection for windshields, glass, and tires, as well as a reduction of the deductible amount payable in case of vehicle damage caused by a collision, acts of vandalism, or in the event of theft or attempted theft of the vehicle. In these cases, the LESSEE and DRIVER will be responsible up to a maximum variable amount (REDUCED deductible) depending on the selected vehicle. The COMPLETE coverage package must be expressly selected if it is not included in your rate. What Is the Deductible? The Deductible is the maximum amount that can be charged to the customer in case of theft or damage to the vehicle at the end of the rental and varies depending on the category of the vehicle and the selected rate. This amount will be deposited when collecting the vehicle. Since a credit card is the only payment method, this system is valid as a guarantee and security to cover the deductible amount if it is charged to the customer. Exclusions The use of vehicles for the transport of dangerous goods is excluded from the insurance. Any protection coverage arranged within the rental contract framework loses its validity if the vehicle is used by an unauthorized driver or if the driver does not possess the required driving license at the time of the insured incident. Additionally, damages caused by voluntary acts of the customer, malicious acts, abnormal use of the vehicle, lack of due diligence (such as refueling the vehicle with the wrong type of fuel), or in case of loss of keys, are excluded. The right to full coverage protection (including theft protection) can be reduced or eliminated if the damages are intentional or caused by gross negligence. If no full protection coverage (including theft protection) has been agreed upon, the lessee and driver will be responsible for all damages to the rental car that cannot be proven to have been caused by third parties and will be liable for up to the total value of the vehicle.
